Two boys, aged 8 and 9, were found to be guilty for the shooting and have been charged with Involuntary Manslaughter.
The Oconee County Sheriff’s Office is charging an 8-year-old and a 9-year-old with Involuntary Manslaughter in the shooting death of 62-year-old Danny Andrew Smith last week, according to Breaking 911.
“We believe that both juvenile males discharged a firearm in a reckless manner in the direction of Mr. Smith who was bush hogging on some family property,” says Oconee County Sheriff Mike Crenshaw, after consulting with the Solicitor’s Office and based on evidence obtained in our ongoing investigation.
“At this moment, it is unknown which of the two shots that killed Mr. Smith was fired. However, according to South Carolina law, the hand of one is the hand of all, which is why both adolescents have been charged with Involuntary Manslaughter in Family Court.”

Marilynn Smith, Smith’s wife, phoned 911 at 9 p.m. on June 23 after being unable to contact her husband via phone. Coffee Road, near Westminster, is the location of the property where he worked.
Mr. Smith was found slumped over the steering wheel, motionless, on a tractor that was still operating but had gone down an embankment, striking a tree, according to a news release. “It was concluded that Mr. Smith had sustained a single gunshot wound to the back based on evidence acquired during the inquiry and from the autopsy.”
“To be charged with involuntary manslaughter, you have to be shooting recklessly. So we believe they fired at Mr. Smith on the tractor, rather than just shooting up in the air,” Sheriff Crenshaw stated. “We don’t believe there was any malice involved. We don’t believe it was premeditated, and we don’t believe they intended to murder Mr. Smith, but recklessly firing a firearm in the direction of another person is deemed involuntary manslaughter.”
“At this point, we don’t know for sure if they knew him,” Sheriff Crenshaw stated.
What a disaster. Those young lads will certainly spend the rest of their life in prison, and Mr. Smith’s family has endured an unthinkable loss.
This is a horrific situation from start to finish. However, more information is needed to determine whether this was simply carelessness or if they knew the man and anything else was going on.
