Democratic California Gov. Gavin Newsom’s put his signature S.B.132 into law in January. That is a bill that orders the California Department of Corrections and Rehabilitation (CDCR) to request each individual to identify their pronouns, gender identity. Also, the prisoners have to tell how they classify themselves, transgender, non-binary, or intersex.
Resulting from the law, CDCR won’t be able to discipline the individual if they refuse to give the information. Also, it allows updating of information, and the staff must use the pronoun that the prisoner required.
The bill requires CDCR to house the prisoners in a “correctional facility designated for men or women based on the individual’s preference.” Connecticut and Massachusetts have passed almost identical legislation.
Since January, more than 261 inmates have requested ‘’gender-based housing’’ transfers when the bill passed. CDCR confirmed this data.
Most of the requests were from individuals asking for transfer into female facilities. Only six inmates didn’t request to be in the female prisons.
Terry Thornton, Deputy Press Secretary, spoke for DCNF.
“255 are from transgender women and non-binary incarcerated people who are requesting to be housed in a female institution, and six are from transgender men and non-binary incarcerated people who are requesting to be housed in a male institution.”
CDCR spokesperson shared that they haven’t denied any gender-based requests.
Twenty-one requests received the confirmation, and even four of them were transported to Central California Women’s Facility in Chowchilla.
“Two of the 21 have changed their minds.’’ – stated Thornton.
Until April 2, precisely 1,129 imprisoners self-identify as transgender, non-binary, and intersex.
Moreover, Chowchilla prison inmates stated that ‘’men are coming’’ and added that they should anticipate sexual violence.
According to Tomeikia Johnson (41), the staffer said, “That if we think it’s bad now, be prepared for the worst. That it’s going to be off the hook, it’s going to be jumping,”
“They say we’re going to need a facility that’s going to be like a maternity ward. They say we’re going to have an inmate program where inmates become nannies.” – Johnson continued.
The scariest thing in this legislation is that the inmates’ transfers are a massive fraud to reach women prisons. The inmates are lying about their self-identification, which slowed down the process.
Thornton said that meetings and discussions “have helped to dispel any fears” and “a person’s gender identity is self-reported and CDCR will evaluate any request submitted by an incarcerated person for gender-based housing.”
In conclusion, Thornton stated that California had to spend several million dollars for this law’s implementation.
