Treason is defined in 18 U.S. Code 2381.
Whoever, owing allegiance to the United States, declares war on them or aids and comforts their enemies within or outside the United States, is guilty of treason and shall be executed, or imprisoned for not less than five years and fined under this title but not less than $10,000; and is ineligible to hold any office under the United States.

Advocating Overthrow of Government – 18 U.S. Code 2385
Whoever knowingly or willfully advocates, aids, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States, or the government of any State, Territory, District, or Possession thereof, or the government of any political subdivision therein, by force or violence, or by assassinating any officer of any such government;
Whoever organizes, assists, or attempts to organize any society, group, or assembly of persons who teach, advocate, or encourage the overthrow or destruction of any such government by force or violence; or becomes or is a member of, or affiliates with, any such society, group, or assembly of persons, knowing the purposes thereof, shall be fined under this title or imprisoned for not more than twenty years.
If two or more people plot to commit any of the crimes listed in this section, each of them will be punished under this title or imprisoned for not more than twenty years, or both, and will be ineligible to work for the United States or any of its departments or agencies for the next five years.
The phrases “organizes” and “organize” as used in this section refer to the process of recruiting new members, forming new units, and reorganizing or expanding existing clubs, classes, and other units of a society, group, or assembly of persons.
